In theory, there are no such thing as a “Private Beach” in Costa Rica, at least the first 50 meters. Some oceanfront properties have been “grandfathered” in, so a few do have a title, but those are few and far between.
The next 150 meters is available for Concession, Costa Rica Concession property is basically a land lease granted in the maritime zone and most commonly has a duration of 20 years.
As an owner of a Costa Rica Concession property you can build on that concession land subject to the zoning laws of the local municipality. Unlike fee simple property, Foreigners do not have the same rights as Costa Rican Nationals when it comes to purchasing a Costa Rican Concession property. However, a plus 5 years resident has the same right to own concession land a Costa Rican national. The Costa Rican law establishes that foreigners cannot be majority owners of a Costa Rican Concession property.
